BiMA·gov Terms of Service

These Terms of Service ("Terms") govern your access to and use of the BiMA·gov software, websites, and services (collectively, the "Service") provided by BiMA·gov ("we", "us", "our"). By creating an account, purchasing a license, or otherwise using the Service, you agree to be bound by these Terms.
1. Acceptable use
You agree not to:
- Reverse engineer, decompile, or disassemble the Service except to the extent expressly permitted by applicable law.
- Use the Service to transmit malware, engage in unauthorized intrusion, or violate the rights of others.
- Resell, sublicense, or redistribute the Service without our prior written consent.
- Exceed the CR quota or seat count of your subscription tier through technical circumvention.
- Use the Service for any unlawful purpose or in violation of any applicable regulation (including export controls).
2. Subscriptions and billing
- Fees are charged monthly or annually in advance via our payment processor (Stripe).
- Usage above your tier's included quota may be billed as overage at the rates listed on our pricing page.
- Subscriptions renew automatically unless cancelled before the renewal date.
- Refunds are issued at our discretion; we do not refund unused portions of a paid-up period.
3. Intellectual property
The Service, including all software, content, and trademarks, is and remains our exclusive property. You are granted a limited, non-exclusive, non-transferable license to use the Service for your internal business purposes during your subscription. You retain all rights to your own data and the Power BI semantic models you process through the Service.
4. Data processing
- We process data you submit (tickets, semantic-model metadata, CR history) to provide the Service.
- We do not sell or share your data with advertisers.
- Aggregated, anonymized telemetry (opt-out available) is used to improve the Service. See our Privacy Policy.
- Where you are the data controller and we are the data processor, we agree to execute a Data Processing Agreement on request.
5. Service availability and SLA
- We target 99.5% uptime for the cloud components, measured monthly.
- The on-premises
bima.execlient remains available offline, subject to license-token expiry. - Scheduled maintenance windows are announced at least 24 hours in advance.
- We are not liable for downtime caused by upstream providers or force majeure.
6. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE IS LIMITED TO THE AMOUNTS YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM. IN NO EVENT ARE WE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES.
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
7. Termination
- You may cancel your subscription at any time via the customer portal.
- We may suspend or terminate your access for material breach of these Terms with 14 days' written notice (or immediately for acceptable-use violations).
- Sections 3, 4, 6, 8, and 9 survive termination.
8. Governing law
These Terms are governed by the laws of the jurisdiction in which BiMA·gov is incorporated, without regard to its conflict-of-laws rules. Disputes will be resolved in the courts of that jurisdiction.
9. Changes
We may update these Terms from time to time. Material changes will be notified at least 30 days in advance by email or via the Service. Continued use after the effective date constitutes acceptance.
